Yebble LLC (“Yebble,” “we,” “our,” or “us”) owns and operates the website https://yebble.com (the “Site”). These Terms of Use (“Terms”) govern your access to and use of the Site, including using any features, submitting business listings or reviews, registering an account, or otherwise interacting with the Site or its services.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Definitions

• “User” / “You” — Any individual or entity accessing or using the Site.
• “Account” — A registered user account on the Site (if registration is required for certain features).
• “Business Listing” — Any business entry submitted or claimed by a business owner or authorized representative, including business name, address, contact info, description, and related data.
• “User-Generated Content” — Any content submitted by users to the Site (e.g. reviews, comments, business information, photos).
• “Services” — All features provided by the Site, including business directory/search, listing submission or claiming, listing display, user reviews/ratings/comments, account management, paid listing packages, and other related functionalities.

2. Use of the Site & License

Subject to your compliance with these Terms, Yebble grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its publicly available content solely for your personal, non-commercial use.

You may view or print pages for personal use. All rights not expressly granted are reserved by Yebble and/or its licensors.

You may not:

• reproduce, duplicate, copy, sell, resell, exploit, or otherwise use the Site or its content for commercial purposes without our express written permission;
• circumvent or bypass any access controls, security measures, or technological protections on the Site;
• use automated means (scrapers, bots, crawlers) to extract data from the Site without prior authorization.

3. User Content — Submissions, Reviews, Business Listings

If you submit User-Generated Content or a Business Listing:

• You grant Yebble a worldwide, non-exclusive, royalty-free, fully paid, sublicensable and transferable license to use, reproduce, modify, publish, translate, distribute and display that content in connection with the Site and Yebble’s business operations.
• You represent and warrant that you own (or have all necessary rights to) the content and that it does not infringe rights of any third party, and does not violate any applicable law.
• You acknowledge that any content you submit — including business listings, reviews, ratings, photos — may be publicly visible, and you accept all risk related to public visibility.
• Yebble is under no obligation to review, monitor, or endorse any User-Generated Content or listings. We reserve the right to remove or refuse any content, listing, or account at our sole discretion (e.g. because of policy violations, inactivity, fraudulent information, spam).

4. Acceptable Use & Prohibited Conduct

You agree not to use the Site (or the Services) to:

• commit or facilitate any unlawful activity;
• post, upload, transmit or share content that is defamatory, obscene, threatening, harassing, hateful, discriminatory, infringing, or otherwise objectionable;
• post false or misleading business information (business name, address, contact info, business type) or fraudulent listings;
• spam, advertise without permission, send unsolicited messages, or engage in disruptive or malicious behavior;
• attempt to interfere with, damage, disable, or impair the Site or its operation (e.g. hacking, malware, automated attacks, denial-of-service, data harvesting);
• impersonate others, create fake or duplicate accounts or listings, or misrepresent any affiliation;
• circumvent or disable any security or access controls, or reverse-engineer parts of the Site or its code.

Violation of these rules may result in immediate suspension or termination of your account or access, and removal of content or listings, at our discretion.

5. Paid Listings, Business Owner Submissions & Payment Terms

If you use or purchase any paid listing package or subscription service on the Site:

• You agree to pay the fees displayed to you at checkout. Payment is processed via our payment processor.
• You represent that you are a legitimate business or authorized representative and that the business information you provide is accurate and valid.
• Paid listings or claims may be suspended, cancelled, or removed if payment fails, terms are violated, or the listing violates our site policies.
• Unless otherwise specified, fees are non-refundable.

Yebble reserves the right to change pricing, modify, suspend or terminate paid services at any time, but will honor commitments for valid paid listings active at the time of change (unless terminated for cause).

6. Disclaimers; “As-Is” Service

The Site and all Services, content, business listings, reviews, and user-submitted content are provided “as is” and “as available.” Yebble makes no warranties — explicit or implied — including but not limited to: accuracy, reliability, completeness, merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.

You acknowledge that you rely on any content — including business listings or user reviews — at your own risk.

7. Limitation of Liability

To the maximum extent permitted by law, Yebble and its officers, directors, employees, agents, affiliates, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, punitive or exemplary damages — including lost profits, lost data, business interruption, or other losses — arising from:

• your use or inability to use the Site or Services;
• reliance on any business listings, user-generated content, reviews, or other information on the Site;
• any errors, omissions, or inaccuracies in content or listings;
• unauthorized access to or alteration of your transmissions or data;
• any other matter related to the Site or its operation, even if we have been advised of the possibility of such damages.

In jurisdictions that do not allow certain exclusions of liability, liability shall be limited to the greatest extent permitted by law.

8. Indemnification

You agree to indemnify, defend and hold harmless Yebble, its officers, directors, employees, agents, affiliates and licensors from and against any claims, damages, losses, liabilities, costs or expenses (including reasonable attorneys’ fees) arising out of or related to:

• your violation of these Terms;
• your use of the Site or Services;
• your submission of User-Generated Content or Business Listings;
• your violation of any third-party right (intellectual property, privacy, etc.); or
• your negligent or wrongful use of the Site.

9. Termination; Suspension

We reserve the right — in our sole discretion — to suspend or terminate your access to the Site, your account, or any Business Listing (free or paid), at any time and for any reason (including violation of these Terms, non-payment of fees, abuse, spam, or inactivity).

Upon termination, your license to use the Site ceases immediately. Provisions that by their nature should survive termination — such as indemnification, liability disclaimers, rights to content licensing, and governing law — will remain in effect.

10. Changes to Terms

We may modify or update these Terms at any time. When we do, we will post the revised Terms on the Site with a updated “Last Updated” date. Your continued use of the Site after posting constitutes acceptance of the new Terms.

If changes are material (for example, affecting your rights or obligations), we may attempt to notify you (e.g., via email, if you have registered).

11. Governing Law; Dispute Resolution

These Terms are governed by and construed under the laws of the State of Massachusetts (without regard to its conflict-of-law provisions). Any dispute arising in connection with these Terms or your use of the Site must be brought in the state or federal courts located in Massachusetts, and you consent to the exclusive jurisdiction and venue of such courts.

13. Miscellaneous / Severability

If any provision of these Terms is found to be invalid, illegal or unenforceable under applicable law, that provision shall be severed or modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

These Terms — together with our Privacy Policy and any other applicable policies — constitute the entire agreement between you and Yebble regarding use of the Site.
